These General Conditions of Use supplement the General Conditions of Sale and the Privacy Policy.


1. OBJECT

The purpose of these General Terms and Conditions of Use (hereinafter referred to as "the T&Cs") is to define and regulate the terms of use of the website www.celiapale.com (hereinafter referred to as "the Site") by users (hereinafter referred to as "Users").

To have access to the Site, as well as to all its services, you must unreservedly accept these General Conditions of Use in their latest version and comply with them.

3. SERVICES OFFERED BY THE SITE

The purpose of the Site is the presentation, sale and promotion of the Publisher's products (hereinafter referred to as "the Services"). These Services include:

• The possibility for the User to purchase one or more products marketed by the Publisher. To do this, he must refer to the General Conditions of Sale made available to him.
• The possibility for the User to subscribe to a newsletter service, allowing him to be regularly informed of the latest news and information relating to the Publisher and its products. To do this, the User must, on the Site, in the Newsletter section, complete his email address, to which he will be sent the newsletter.

5. ACCEPTANCE OF THE TOS

Access to and use of the Site are subject to acceptance and compliance with the T&Cs. This acceptance and this respect are deemed to be given by the User at the opening of the Site.

The T&Cs apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.

The Publisher reserves the right to modify, at any time and without notice, the Site, the Services as well as the T&Cs, in particular to adapt to the evolutions of the Site by the provision of new functionalities or the deletion or modification of existing functionality.

It is therefore advisable for the User to refer before any navigation to the latest version of the T&Cs, accessible at any time on the site. In the event of disagreement with the T&Cs, no use of the site may be made by the User.

6. ACCESS AND NAVIGATION

Access and navigation on the Site, allowing you to benefit from the Services, is done through an Internet connection.

The Publisher implements the technical solutions at its disposal to allow access to the Site 24 hours a day, 7 days a week.

The Publisher is subject to an obligation of means with regard to access and navigation on the Site and makes its best efforts to guarantee this access and this navigation. However, it cannot be held responsible for malfunctions of the Site and unavailability of the Services and cannot therefore pay any compensation to the User.

7. RESPONSIBILITIES

The Editor is only responsible for the content that he has edited himself.
However, it cannot guarantee the accuracy, completeness and timeliness of the information published on the Site.

The Publisher is not responsible:
• technical, computer or compatibility problems or failures of the Site with any hardware or software;
• direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or difficulties in using the Site or the Services;
• the intrinsic characteristics of the Internet, in particular those relating to the lack of reliability and the lack of security of the information circulating on it.

The following are strictly prohibited: (i) any behavior likely to interrupt, suspend, slow down or prevent the proper functioning of the Site, (ii) any intrusion or attempted intrusion into the Publisher's systems, (iii) any misappropriation of resources system of the Site, (iv) any action likely to impose a disproportionate burden on the latter's infrastructure, (v) any breach of security and authentication measures, (vi) any act likely to infringe the rights and financial, commercial or moral interests of the Publisher or the users of its Site, (vii) any practice diverting the Site to purposes other than those for which it was designed and finally more generally (viii) any breach of the T&Cs or applicable laws and regulations.

It is also strictly forbidden to monetize, sell or grant all or part of the access to the Site, as well as to the information it contains.

In the event of failure to comply with any of the provisions of this article or more generally, infringements of laws and regulations, the Publisher reserves the right to take all appropriate measures, to seek damages and to engage all lawsuit.

8. HYPERTEXT LINKS

The Site may contain hypertext links pointing to other websites over which the Publisher has no control. Despite the prior and regular checks carried out by the Publisher, the latter declines all responsibility for the content that can be found on these sites.

In addition, the prior information of the Site Editor is necessary before any establishment of hypertext links.

Excluded from this authorization are sites disseminating information of an illicit, violent, controversial, pornographic, xenophobic nature or which may affect the sensitivity of the greatest number.

Finally, the Publisher reserves the right to have a hypertext link pointing to its Site removed at any time, if it deems it does not comply with its editorial policy.

The Publisher is not responsible for transactions between the User and any advertiser to which the User would be directed through the Site and can in no way be a party to any dispute in this regard.

10. INTELLECTUAL PROPERTY

The structure of the Site but also the texts, graphics, images, photographs, sounds, videos, computer applications and databases, which compose it, as well as the trademarks and other intellectual property rights relating to the Publisher's products presented, sold and promoted on the Site (hereinafter referred to as "the Protected Elements"), are the property of the Publisher and are protected as such by the laws in force under intellectual property.

Any representation, reproduction, adaptation or partial or total exploitation of the Protected Elements, by any process whatsoever, without the prior, express and written authorization of the Publisher, is strictly prohibited and could constitute an infringement within the meaning of the provisions of the Intellectual Property Code.


Access to the Site and its use do not constitute recognition of a right and, in general, does not confer any intellectual property rights relating to the Protected Elements, which remain the exclusive property of the Publisher.

The User is prohibited from entering data on the Site that would modify or could modify its content or appearance.

11. APPLICABLE LAW AND JURISDICTION

The T&Cs are governed by French law.

In the event of a dispute and in the absence of an amicable agreement within one (1) month of the occurrence of the dispute, the dispute will be brought before the competent courts of Toulouse-France.
